C a. whereas the Directive on combatting violence against women and domestic violence does not contain a harmonised definition of the offence of rape based on the absence of consent; whereas to pave the way for a legislation containing such a definition, it is crucial to extend the list of areas of crime under Article 83(1) TFEU to gender-based violence;
