In order to determine whether a purported traineeship constitutes a regular employment relationship requiring corrective action, competent authorities shall make an overall assessment of all relevant factual elements in particular the facts relating to the actual performance of work irrespective of how the relationship is designated in any contractual arrangement that may have been agreed between the parties involved. That assessment shall take into account, among others, the following indicative elements:
