Subject: Agreement between BOTAS, a Turkish state-owned corporation, and its Bulgarian counterpart, Bulgargaz/Bulgartransgaz

Bulgaria’s current Prime Minister and Energy Minister have both spoken publicly of their concerns about an agreement signed in January 2023 between the Turkish state-owned company BOTAS and its Bulgarian counterpart Bulgargaz/Bulgartransgaz. The agreement has given rise to growing concerns as to its impact on the EU’s policy to limit energy imports from Russia. In October 2023, the Commission indicated that it was reviewing the terms of the agreement.

Can the Commission indicate:

1. The full scope of its examination;

2. The expected time frame of the examination; and,

3. Whether it has the power to access all provisions of the agreement to ensure that they meet the requirements of EU law and align fully with EU energy policy.

The Commission is closely following the developments on the Bulgarian gas market and the south-eastern region at large, in particular since the start of the unprovoked Russian war of aggression on Ukraine and the cut off of Gazprom supplies to some Member States.

The Commission is in close contact with the Bulgarian authorities to support the diversification process in the region, and to ensure compatibility with EU law and avoid risks for gas supply security. In the case at hand, the Commission has been in touch with the relevant authorities and stakeholders and has been gathering documents, views and data on the agreement, including by sending requests for information.

In case of indications of non-compliance with EU law, including a breach of EU competition rules, the Commission will take appropriate action.

At this point in time, however, the Commission cannot give any indication on the possible outcomes of this assessment nor on a timeline as the analysis is ongoing.
