In its answer to question P-000171/2024, the Commission states that Directive 2006/123/EC on services in the internal market (the Services Directive) applies to a wide variety of services which are defined in a broad manner as self-employed economic activities normally provided for remuneration. It also recalls that the Court of Justice of the European Union clarified that ‘Article 4(1) of Directive 2006/123 must be interpreted as meaning that the activity of retail trade of goods constitutes a “service” for the purposes of the application of that directive’. Is itinerant trade also a ‘service’ for the purposes of applying that directive?

Itinerant trade falls within the definition of ‘service’ for the purposes of applying Directive 2006/123/EC on services in the internal market (the Services Directive (1)). Itinerant trade can be considered, in fact, as a self-employed economic activity provided for remuneration that does not fall under the exclusions from the scope of the Services Directive listed in Articles 2(2) and 2(3) of that directive.

In this respect, it can be recalled that Recital 33 of the Services Directive emphasises that the services covered by that directive concern a wide variety of ever-changing activities and expressly states that included within those activities are services provided both to businesses and to consumers, such as distributive trades.

Eventually, ‘itinerant trade’ can be considered as a form of ‘retail trade’, that, as the Honourable Member recalled, has been considered by the Court of Justice of the European Union as falling under the scope of the Services Directive (2).
