Subject: Approval of a new business plan for the packaging waste management system ‘Rewarding Recycling’

The Commission has found that one of the main reasons why Greece performs poorly in the area of recycling1 is its lack of infrastructure for sorting recyclable materials at source2.

On 15 February 2021, the Hellenic Recycling Agency approved the business plan of Rewarding Recycling S.A., one of two producer responsibility organisations for packaging waste in Greece, without taking into account the fact that, for some time, source sorting targets had not always been achieved, the economic viability of the business plan, and the fact that the service recommendation had been rejected3. On 13 May 2020, before the business plan was approved, another producer organisation – Hellenic Recovery Recycling Corporation – backloaded equipment to municipalities for a four-stream waste collection. In parallel, the competent authorities (the State and Solid Waste Management Bodies) are using State funding to procure separate collection equipment for waste streams that is supposed to be provided by producer responsibility organisations.

In view of this:

1. How does it gauge the effectiveness of the implementation of extended producer responsibility in Greece thus far?

2. Does it intend to revise its recommendations to Greece in the context of the implementation of Directives (EU) 2018/851 and 2018/852, especially given that Greece has not met the recycling target set for 2020?

The latest report that discusses the extended producer responsibility (EPR) scheme in Greece and sets out recommendations for improvement is the early warning report published in 2018 (4).

The key indicator for the Commission in assessing how successful are the national waste management systems, is Member States’ compliance with the recycling targets laid down in EU waste legislation.

Article 8a in the Waste Framework Directive (WFD) (5) aims to improve the governance, transparency and efficiency of the EPR schemes.

The Member States should ensure that the new rules are transposed and implemented, including the responsibility of the producers to cover the necessary costs of separate collection and subsequent treatment to meet the targets and objective set by the WFD, the Packaging and Packaging Waste Directive (PPWD) (6) and possibly by national legislation.

The deadline for transposing and implementing the amended WFD and PPWD was on 5 July 2020 for all Member States. The Commission is assessing if the transposing laws are in line with EU legislation. The Commission is also preparing guidelines on the implementation of some provisions of Article 8a.

Article 37 and Article 10(6) of the WFD also require that the Member States submit implementation reports. These reports need to include some qualitative information regarding the implementation of separate collection and attainment of recycling targets.

By end 2022, the Commission plans to adopt the early warning reports concerning the attainment of the 2025 recycling targets in the WFD and the PPWD. The Commission will assess the progress of all Member States, including Greece, towards meeting the 2025 recycling targets.
