Subject: Asylum, Migration and Integration Fund (AMIF) - follow-up question

Following the Commission’s answer to question P-000048/2018, can it provide further clarification on the following two points:

The Commission stated that it checks whether actions funded under the Asylum, Migration and Integration Fund (AMIF) are in compliance with fundamental rights and respect human dignity. How does it do that?

What concrete measures is the Commission allowed to take, under EU law and in line with the Treaties, against Member States failing to comply with the rules under the AMIF regulation?

The Commission has two ways of checking whether actions funded under the Asylum, Migration and Integration Fund (AMIF) are in compliance with the Charter of Fundamental Rights of the EU and respect human dignity.

Firstly, the Commission reviews the projects submitted by Member States, as part of the yearly submission of their accounts, which provide the basis for payments. Secondly, the Commission ensures regular monitoring visits to the projects.

If a project is found to be in non-compliance with the principles of the Charter, the Commission will not cover the costs through AMIF and will proceed to a financial correction, in accordance with Article 47 of Regulation (EU) No 514/2014 (1). Article 47 allows for the full recovery of the amounts paid by the EU, including amounts paid through pre-financing.

As already mentioned in the reply to Written Question P-000048/2018, under the so-called Shared Management, the responsibility for the implementation of the National Programmes lies with the Member States, therefore, Member States must ensure that all actions are in compliance with the Charter of Fundamental Rights of the EU and respect human dignity. If in the context of monitoring the Commission detects a problem which may imply serious deficiencies in the management and control system of the Fund at national level and which may put the EU contribution at risk, then payments of the annual balance to a Member State can be fully or partially suspended in according to Article 42(a) of Regulation (EU) No 514/2014.
