Subject: Deinstitutionalisation of care for persons with intellectual disabilities

Article 19 of the Convention on the Rights of Persons with Disabilities (CRPD) states that a systemic approach to deinstitutionalisation is needed to achieve a genuine and successful transition to independent living. Community-based organised housing services for people with intellectual disabilities allow us to combat social stigmatisation and improve social integration. The main aim is to build skills to strengthen residents’ social inclusion. Through the European care strategy, people with intellectual disabilities should be provided with accessible, affordable, high-quality, and available care services. However, we see violations of these norms in some Member States.

1. In the light of Article 19 of the CRPD, how does the Commission support Member States in developing adequately funded, human rights-compliant strategies (with clear periods and benchmarks) for the provision of community-based organised housing services to support the deinstitutionalisation of people with intellectual disabilities?

2. How does the Commission evaluate Member States’ efforts to implement the European care strategy with regard to care for persons with intellectual disabilities?

3. The insufficient funding of social services provided by civil society organisation service providers breaches the care strategy. What is the Commission’s response to the actions concerning this insufficient funding?

In line with the European Care Strategy (1) and the Council Recommendation on long-term care (2), Member States are recommended to ensure adequate and sustainable funding for long-term care, including by mobilising EU funds and instruments.

The EU supports and complements the activities of the Member States as concerns the modernisation of social protection systems. The implementation of the Council Recommendation will be monitored through the European Semester and the social Open Method of Coordination. The Commission will report to the Council on its implementation by December 2027.

The Commission monitors through the European Semester the social inclusion of persons with disabilities, including persons with intellectual disabilities and the process of deinstitutionalisation.

It supports capacity-building to prepare, design and implement reforms with the Technical Support Instrument (3). Several Member States are using this demand-driven instrument for reforms to advance with deinstitutionalisation processes.

Investments in this area can be supported with EU funding, for instance the European Social Fund+ (ESF+) supports skills for independent living, or support upskilling and reskilling of the workforce, enhancing access to quality and affordable care services in the community and improving the effectiveness and resilience of long-term care services (4).

The Recovery and Resilience Facility also funds investments and reforms in long-term care. All relevant funding programmes have been adopted and implementation has started. (5)

In addition, the ESF+ is funding a helpdesk through which social service providers and managing authorities in all Member States can receive tailored support and advice on how to access and use EU funds (6).

4 ∙ ⸱ The allocated funding under the European Social Fund+ for 2021-2027 period for the Measures to enhancing the delivery of family and community-based care

services amounts to 1.685.350.51 EUR of EU contribution and 2.633.529.004 EUR total allocation (including national co-funding) for all shared management funds. 5 ∙ ⸱ In addition, all Funds under the Common Provisions Regulation have to fulfil a horizontal enabling condition on the existence of a framework for implementing the

United Nations Convention on the Rights of Persons.

There are also two thematic enabling conditions which are applicable when the Member States programme under the corresponding specific objectives: ‘national strategic policy framework for social inclusion and poverty reduction’ and ‘strategic policy framework for health and long-term care’. Both contain a criterion on specific measures for the shift from institutional to family and community-based care for the Cohesion Policy funds. 6 ∙ ⸱ https://eufunds4social.eu/
