Subject: EU Pilot procedure concerning plans to build an incinerator in Santa Palomba, Rome

The DIRE news agency has reported on the main stages of the EU Pilot procedure launched by the Commission in 2019 concerning waste management in the Municipality of Rome and the Lazio Region. In 2022, the Draghi Government made the current Mayor of Rome, Roberto Gualtieri, a Commissioner with powers to build the facilities necessary to ensure that the Italian capital can once again manage its waste autonomously.

Gualtieri had the Rome Waste Plan drawn up, which provides for the construction of a 600 000-tonne incinerator.

On 9 January 2023, the Commission’s Directorate-General for Environment wrote to the Italian Ministry for European Affairs’ Office for Infringement Proceedings, asking the Italian authorities to provide more information on the planned incinerator’s compliance with the waste hierarchy and with the recycling and separate collection targets laid down in the Lazio Waste Management Plan, recalling Article 4 of the Waste Framework Directive (2008/98/EC), which establishes a waste hierarchy.

In the light of the above:

1. Will the Commission confirm whether the above report is accurate?

2. Will it make all documentation concerning the aforementioned EU Pilot procedure public?

3. Will it make all subsequent proceedings public?

The project to build an incinerator in Santa Palomba is one aspect of the EU Pilot investigation mentioned by the Honourable Member which relates more broadly on the implementation of a functional waste management system in Lazio.

The assessment of the Italian authorities’ answer is currently ongoing under the above-mentioned investigation. Based on the outcome of its assessment, the Commission will decide on the appropriate course of action.

The EU Pilot dialogue is a cooperation procedure based on mutual trust between the Commission and the Member States allowing the Commission to resolve a number of cases without the need to move to an infringement procedure.

This may be the case, for example, if the issues at stake are of a technical nature. In this respect, information related to an ongoing EU Pilot dialogue remains confidential until this informal stage is closed and there is a definitive decision by the Commission on whether or not to open a formal infringement procedure against the Member State, as its disclosure could have a negative impact on the loyal cooperation between the Commission and the Member State to ensure compliance with EU law and avoid legal proceedings (1).
