Subject: Follow-up question: Transposition of the Work-Life Balance Directive

The Work-Life Balance Directive was adopted in 2019. Its aim is to achieve a better balance between family and work obligations.

Member States were required to transpose the directive into national law by 2 August 2022 at the latest. In its answer dated 14 October 2022 (P-002835/2022(ASW)1) the Commission stated that only eight Member States had transposed the directive into national law.

1. Can the Commission say which Member States had transposed the directive by 18 March 2024?

2. Will Member States that have failed to meet the deadline be penalised?

The work-life balance Directive 2019/1158 (2), adopted in 2019, is an important legislation which aims to enable working parents and carers to better reconcile professional and private lives.

It also aims to tackle the unequal sharing of caring responsibilities between men and women. The Member States had until 2 August 2022 to transpose the directive into national law (3).

In November 2023, the Commission decided to refer Belgium, Ireland and Spain to the EU Court of Justice, asking the Court to impose fines on these Member States for lack of communication of complete transpositio n (4). Subsequently, Ireland notified complete transposition of the directive at the beginning of March 2024.

On 18 March 2024, all Member States had completed the transposition, with the exception of Belgium and Spain.
