Subject: Funding through loans and non-repayable direct aid

The Recovery and Resilience Facility provides funding to Member States through loans as well as non-repayable direct aid. Spain submitted the National Recovery, Transformation and Resilience Plan to apply for non-repayable direct aid, for which it has already received pre-financing and a first tranche of funding. It has also already submitted a second request for funding.

States may apply for the loans part until 31 August 2023. According to statements by Commissioner Gentiloni before Parliament, Spain will in the very near future request some EUR 70 billion under the loans section of the Facility. In connection with that request, Spain has to submit a new recovery plan or an amendment to the recovery plan already submitted, including the new milestones and targets justifying the increase in funding.

With that in mind:

1. Has the Spanish Government submitted any details to the Commission regarding the new national recovery plan for the request for financing by means of loans?

2. Has the Spanish Government provided the Commission with any information on any consultations or work it may be doing with the local and regional authorities on these amendments and addenda?

The Spanish Government has not yet presented the Commission with any advanced information on updates or amendments to the recovery and resilience plan (RRP) nor has it presented information on consultations with local and regional authorities regarding such updates or amendments.

Based on Article 18(2) of the regulation establishing the Recovery and Resilience Facility (RRF) (1), Member States can present an update of the RRP to take into account the updated maximum financial contribution following the calculation referred to in Article 11(2) of the regulation. The Commission has made public the updated maximum financial contributions on 30 June 2022, in line with the regulation.

As set out in Article 12(3) of the RRF Regulation, the 30% remaining of the maximum financing contribution shall be made available for allocation before 31 December 2023.

As set out in Article 14(2) of the RRF Regulation, the final deadline for the submission of all loan requests, including those allocated under Article 14(6) of the RRF Regulation, is 31 August 2023.

As set out in the Commission Guidance on Recovery and Resilience Plans in the context of REPowerEU (2), Member States should provide a summary of the consultation process conducted in accordance with their national legal frameworks, leading up to the submission of the updated/amended RRP.
