For citizens covered by Articles 17, 24, 25 and 26 of Regulation (EC) No 883/2004 (convention beneficiaries), it is unclear and uncertain how, in situations which fall outside the scope of Regulation (EC) No 883/2004, Member States apply Recommendation No S2 of 22 October 2013 concerning the entitlement to benefits in kind to them during temporary stays in third countries:

– with which they have concluded a bilateral agreement on social security, including provisions on benefits in kind with regard to sickness;

– with which they have not concluded a bilateral agreement, or one which does not contain the abovementioned provisions.

1. To what extent and in what way does each Member State, in its capacity as a State of residence or as the competent Member State, treat pensioners entitled to benefits under a convention as equal to or different from pensioners insured under its own legislation when it comes to entitlement to medical benefits during a temporary stay which does not fall under Regulation (EC) No 883/2004?

2. Within what time frame can the European Commission provide, per Member State, the clarity requested by pensioners entitled to convention benefits regarding whether and how each Member State will respond to a request for entitlement to medical benefits made by them outside the scope of Regulation (EC) No 883/2004?

3. Could the addition of a provision to Article 27 of the regulation substantially improve legal certainty and equality?

1. According to Recommendation S2 of the Administrative Commission (1), pensioners are entitled to receive benefits in kind during a temporary stay in the third country, on behalf of the competent Member State, under the bilateral convention between the competent Member State and the third country. If the Member State of residence has concluded a bilateral convention with a third country and the insured person would, according to the provisions of the convention, be entitled to receive sickness benefits in kind, the provision of these benefits is not precluded by Regulation (EC) No 883/2004 (2).

2. These situations fall outside the scope of Regulation (EC) No 883/2004 and are within the exclusive competence of the Member States. Since the adoption of Recommendation S2, the Commission has not been aware of such cases and thus is not able to provide such information.

3. Under the current legal framework, an addition to Article 27 of Regulation (EC) No 883/2004 to cover situations of access to benefits in kind during a stay in a third country would not be possible since, based on Article 48 of the Treaty on the Functioning of the European Union, the provisions of Regulation (EC) No 883/2004 apply exclusively to cross-border situations within the EU.
