Subject: Proposal for the European Health Data Space

The proposal for the European Health Data Space1 (EHDS) is of considerable significance for health researchers. The EHDS has the potential to speed up advances in medical technology and enhance the prospects of discovering novel treatment options for patients. By fostering collaboration between researchers and healthcare providers, the proposed EHDS could revolutionise the approach to medical research in Europe, strengthening European leadership in biomedical research and technology and contributing to better health for European citizens.

In view of this:

1. Could the Commission provide an update on the current status and progress toward creating a framework for data sharing and interoperability among EU Member States within the EHDS initiative?

2. What steps is the Commission taking, beyond the current proposal, to address potential barriers to the implementation of the EHDS, including variations in data protection regulations among Member States, notably the General Data Protection Regulation2(GDPR)?

3. How does the Commission plan to ensure the seamless integration of the EHDS into the broader EU research and innovation strategy, while maintaining the highest standards for the privacy and security of personal health data?

The proposal for a regulation on the European Health Data Space (EHDS) (3) is currently in the final steps of the legislative process. Preparatory work in view of its implementation is ongoing, with interoperability and data sharing in the focus.

The rollout of EHDS-related infrastructures, including MyHealth@EU and Health Data Access Bodies (HDABs), is supported by 44 new projects funded under the EU4Health Programme.

Although the General Data Protection Regulation (GDPR) (4) provides a consistent set of data protection rules in the EU, it relies on Member State law to put in place safeguards that would allow the processing of special categories of personal data, such as health data. Consequently, there is a risk of fragmentation due to such national rules.

The Commission is currently preparing the second report on the application of the GDPR, where it will take stock of the implementation, including among other topics, of the level of fragmentation.

The Commission aims to catalyse the use of EHDS provisions in the EU research and innovation ecosystem. For example, the Horizon Europe project QUANTUM (5) aims at delivering a data quality framework contributing to the EHDS.

Moreover, the EHDS will provide clear rules, e.g. for data holders’ obligation to make data available for a number of purposes including research.

At the same time, measures are foreseen to uphold privacy and security standards, including the establishment of HDABs as trust anchors. European Research Infrastructure Consortia (ERICs) and European Digital Infrastructure Consortia (EDICs) are encouraged to join the HealthData@EU infrastructure as authorised participants, and the EHDS Board will facilitate among other tasks collaboration with the research community.
