Subject: Restriction on EMFF applications from collective entities or fishermen's associations

According to the Commission’s (DG MARE’s) interpretation of the European Maritime and Fisheries Fund (EMFF) Regulation, which has been passed on to the Portuguese MAR2020 managing authority, collective entities or fishermen’s associations cannot become actual beneficiaries of support for investment on board or in individual equipment. This explanation has been prompted by an application from an association that was seeking to install safety equipment and systems on board fishing vessels and to train fishermen.

Bearing in mind the following points:

– EMFF implementation levels are low because the Fund does not match the sector’s needs;

– applying for support on an individual basis involves greater difficulty;

– it is important – and that fact is recognised in the Common Fisheries Policy – to promote fisheries sector associations;

– it is important to increase safety on board, especially in the small-scale coastal and artisanal fleet segment, if need be by going beyond the legal requirements so as to keep pace with technological development;

To impose a restriction of this kind is considered to make no sense, as it is harming many fishermen and shipowners who might be able to benefit from the project concerned here or other projects along similar lines.

Is the Commission willing, therefore, to change its interpretation of the EMFF Regulation or, alternatively, to amend that regulation as a matter of urgency in order to overcome the restriction described above?

Article 32 of the European Maritime and Fisheries Fund (EMFF) Regulation (1) provides support to investments in order to improve health, safety and working condition of fishermen.

Paragraph 2 of this Article clearly spells out that such support has to be limited to fishermen and vessel owners. This does not leave any room for interpretation of the provisions agreed by co-legislators in 2014. Therefore, any change to this would necessitate an amendment of the EMFF Regulation.

The Commission proposal for the EMFF post 2020, which is currently discussed by the co-legislators, includes the possibility to support operations improving the health, safety and working conditions on board fishing vessels even with a maximum aid intensity rate of 75%, upon the conditions that the fishing capacity of the vessel receiving support is not increased and that the investment goes beyond the applicable legal requirements. Further eligibility rules will have to be determined by Member States authorities.

Under the current EMFF, as regard training for fishermen organised by collective entities or fishermen's associations concerning safety on board, this type of action could be financed under Article 29 (promotion of human capital, job creation and human capital).

All costs of such training, including the renting of sufficiently equipped vessels for training purposes, may be eligible within this measure. Final rules on eligibility are, however, subject to national level legislation in accordance with Article 65(1) of the Common Provisions Regulation (2).
