Subject: Rule of law infringement in the UK

On 28 August the UK Prime Minister announced his intention to suspend the UK national parliament from 11 September to 14 October 2019, which will have the effect of preventing Parliament from performing its legislative function, exercising checks and balances over the executive, and, in particular, from taking parliamentary action in relation to the Brexit process.

Is the Commission aware of any precedent where a Member State has suspended its parliament for such a length of time or at such an important moment?

How does the Commission assess the UK’s compliance as a current EU member with EU rule of law standards, and, in particular, with the respect for the fundamental values referred to in Article 2 of the Treaty on European Union (TEU)?

The Commission has previously launched infringement procedures against Member States by invoking Article 7 of the TEU, so will the Commission consider doing so urgently in this case, considering the clear risk of a serious breach by the UK of the values referred to in Article 2 TEU?

Joint answer given by First Vice-President Timmermans on behalf of the European Commission (29 October 2019)

The Commission is following closely the developments in the United Kingdom (UK).

The primary responsibility to ensure respect for the values referred to in Article 2 of the Treaty on European Union and on which the Union is founded rests with each Member State, and the first recourse should always be to national redress mechanisms.

The Commission notes that legal challenges against prorogation of the UK national parliament have been brought before the courts of the UK and that the Supreme Court has ruled on the issue.
