Subject: San Vittore del Lazio incineration plant and its breaches of applicable EU rules

The incineration plant at San Vittore del Lazio would appear to be incorrectly classified as an R1 energy recovery plant. Specifically, it functions with three lines of incineration:

line 1, commissioned in 2016 following the revamping of the pre-existing lines that had been in place from 2002 to 2011,

and lines 2 and 3, in operation since 2011.

The technical annex of the environmental impact assessment (of 2016) granted for the plant shows that a climate correction factor (CCF) of 1 382 was used to calculate the R1 index, a value outside the limits set in Directive (EU) 2015/1127.

A CCF of 1 382 means that incineration lines 2 and 3 have an R1 of 0.70 although under Directive 2008/98/EC this should be 0.633.

Subsequent authorisations were granted on the basis of the 2016 environmental impact assessment, and the plant’s resulting R1 value has not been updated.

An extension to the plant with a fourth line for energy recovery operations has since been authorised on the same grounds.

In view the above:

1. Does it consider there to have been a breach of European waste management legislation here, specifically of Directive (EU) 2015/1127 and Directive 2008/98/EC?

2. Is the incineration of CER 19.12.10 waste permitted in D10 plants?

3. Does the Commission intend to include this project in EU Pilot Procedure 2019/9541, the Commission’s investigation into Lazio’s waste management system?

1. The ‘R1 energy efficiency formula’ sets out criteria for when municipal waste incineration is energy efficient and may be considered as a recovery operation. Waste-to-energy plants are higher up in the waste hierarchy than landfills or incineration without energy recovery (1). It is therefore important that Member States classify their incinerators in line with the above formula and the Commission’s guidelines on its interpretation (2). In view of the available information, it cannot be concluded that this classification is incorrect.

2. It is the responsibility of competent authorities to authorise the types and quantities of waste to be incinerated in accordance with the Waste Framework Directive. The Industrial Emissions Directive (3) regulates emissions from waste incineration with or without energy recovery and for all types of waste.

3. The EU Pilot (2019)9541 aims to monitor the implementation of a functional waste management system in Lazio in line with the objectives of the Regional Waste Management Plan. It does not address the technical characteristics of each plant located in Lazio. As regards the construction of the fourth incineration line at the San Vittore plant, the Italian authorities explained that it would not increase the total incineration capacity of the plant.
