Subject: Sustainable urban development funds to achieve the objectives of the Green Deal

Article 7 of Regulation (EU) No 1301/2013 on the ERDF states that, over the period 2014-2020, at least 5% of ERDF resources should be used to finance integrated actions for sustainable urban development. Following the negotiations on the new ERDF Regulation for the period 2021-2027, this percentage increased to 8% given the importance of urban areas in achieving the ambitious goals of the Green Deal.

In this regard, projects carried out in certain localities, such as the renovation of Río Jarama street in Toledo (Spain), seem not to meet the sustainability requirements set out in the Common Provisions Regulation or the 2014-2020 ERDF Regulation.

The renovation of Rio Jarama street, which is 80% co-financed by European funds, does not include any green infrastructure (charging points, trees, etc.) contributing to a ‘sustainable’ objective over the two kilometres of public roads being renovated.

1. What action does the Commission intend to take to ensure that sustainable urban development funds are invested in projects that improve the liveability and sustainability of our cities?

2. What control mechanisms are in place to ensure the correct use of these funds in the Member States?

By virtue of the shared management principle, the selection and implementation of operations supported by the European Regional Development Fund (ERDF) is the responsibility of national authorities. In particular, as regards sustainable urban development (SUD) strategies (1) the selection and implementation of the operations are delegated to municipalities. The managing authority (Ministry of Finance) verifies that the co-financed projects are carried out, that the expenses declared by the beneficiaries have been paid and that the operation complies with applicable law. It also ensures that the conditions of the operational programme and the conditions for supporting the operation are respected.

Sustainability and adaptation to climate change are among the horizontal criteria that must be taken into account for the selection of operations supported by the ERDF (2).

The Commission consulted the managing authority and, according to the information received, the municipality of Toledo consulted the citizens and the social and environmental associations. Different inputs were taken into account for the preparation of the strategy.

The verifications of the regularity of declared expenditure is the responsibility of the national audit authority. The Commission carries out its own audits and, in the event of irregularities, the Member State must take corrective measures, including financial corrections. However, for the project under consultation, the Commission has not yet received a request for reimbursement.
