Subject: The importance of the proposal for a directive on European cross-border associations for European Universities alliances

1. What is the importance of the proposal for a directive of the European Parliament and of the Council on European cross-border associations (COM(2023)0516) for the Commission to encourage European Universities alliances to seek legal personality, and is it an option to consolidate alliances driven by the Commission’s priorities?

2. Is there a set time frame for the adoption of the proposal for a directive of the European Parliament and of the Council on European cross-border associations?

3. Does the Commission plan to adopt a specific form of legal entity dedicated to European Universities alliances, in order to achieve their objectives better than the European cross-border association or any other form already existing under EU law?

1. The proposal for a directive on European cross-border associations (1) requires Member States to create a new legal form of non-profit associations which aims at facilitating their activities across the EU by granting them mobility rights. University alliances will be able to use this legal form provided that they fulfil the conditions of the directive (have minimum 3 founding members with links to at least two Member States and have a non-profit purpose).

2. The Commission takes note of the growing importance of institutionalised forms of cooperation in higher education. Currently, 12 of the 50 European Universities alliances have already set up a legal entity, via national legal instruments (2). In 2022, the Commission launched projects under the Erasmus+ programme (3) to examine the use of existing institutionalised cooperation instruments at European level providing a possible legal status for higher education institutions alliances. Preliminary results obtained by four Erasmus+ projects point to the added value of an improved legal instrument at European level. In 2024, the Commission will publish a report on the final results.

3. On 13 March 2024, the European Parliament adopted its first reading position. Discussions in the Council started in March 2024 and are ongoing.

4. In the communication on a blueprint for a European degree (4), the Commission proposed several entry levels into the pathway towards a European degree, including a European degree awarded by a legal entity established by several universities from different countries. Based on the outcomes of the Erasmus+ projects, the Commission will continue to work to take further steps towards establishing a legal status for alliances of higher education institutions.
