Subject: Transposition of the directive on the European emissions trading system
Directive (EU) 2023/959 establishing a system for greenhouse gas emission allowance trading within the Union was adopted on 10 May 2023. The emissions trading system is the backbone of the European Green Deal and the Fit for 55 package, and transposition therefore needs to be a matter of priority. Member States were required to comply with most of the new requirements by 31 December 2023.
1. Can the Commission say which Member States had transposed the relevant provisions of the directive by 18 March 2024?
2. Will Member States that have not yet transposed the necessary parts of the directive be penalised?

1. Member States were due to transpose Directive 2023/959 partially by 31 December 2023, as certain provisions relating to the new EU Emissions trading system (EU ETS) on buildings, road transport and additional sectors (ETS2) have a later transposition deadline set on 30 June 2024. By 10 April 2024, the Commission received either complete or partial notifications from Austria, Belgium, Czechia, Denmark, Finland, Lithuania, Latvia, Poland and Sweden. The Commission is currently assessing the notifications received from Member States.
2. In line with the communication from 19 January 2017 ‘EU law: Better results through better application’ (1), the Commission investigates cases where Member States have failed to communicate transposition measures as a priority. For this reason, on 24 January 2024, the Commission launched infringement proceedings and sent letters of formal notice to the 26 Member States that had not notified complete transposition of Directive (EU) 2023/959 on tim e (2) (all except Denmark). Currently, the Commission is reviewing the replies of Member States to the letters of formal notice and it may decide on the next steps accordingly, including sending reasoned opinions under Articles 258 and 260(3) of the Treaty on the Functioning of the European Union.
In any case, the application date of the amendments of the EU ETS remains the same for all Member States. As per Article 5 of Directive 2023/959, the provisions entered into force on 5 June 2023.
