Subject: Use of funds under the Recovery and Resilience Facility and conditions set by the stability pact

Of the amount earmarked for loans to Member States under the Recovery and Resilience Facility (RRF), approximately EUR 220 billion (around 57% of the total envelope) is as yet unclaimed. The fact that debt taken out under the RRF further increases the indebtedness of Member States – something that many of them can ill afford in view of the stability pact rules, which have been suspended only until 2023 – will inevitably make Member States reluctant to incur more debt.

In view of the above:

1. What is the Commission’s assessment and what reasons has it identified for the failure of the loan part of the RRF?

2. Will it allow steps such as the repeal of the stability pact and cancellation of ‘COVID debt’ to facilitate access to these funds?

Member States are responsible for setting the scope and size of their Recovery and Resilience Plans. They may request Recovery and Resilience Facility (RRF) loans until 31 August 2023 to finance investments and reforms additional to those financed by the RRF grants.

The Commission’s REPowerEU proposal encourages Member States to request RRF loans to support reforms and investments contributing to REPowerEU objectives and introduces an obligation for Member States to announce their intention to request loans within one month of the entry into force of the regulation. The Commission regularly enquires about Member States intentions regarding loans.

Based on the Protocol No 12 on the Excessive deficit procedure annexed to the Treaty on EU and to the Treaty on the Functioning of the EU and based on the European System of Accounts (ESA2010) (1), no expenditure can be excluded from the general government debt and deficit calculations.

The Country-Specific Recommendations adopted as part of the 2022 European Semester support the use of RRF loans. The Council has recommended all Member States to ‘In 2023...Expand public investment for the green and digital transitions, and for energy security taking into account the REPowerEU initiative, including by making use of the Recovery and Resilience Facility and other Union funds’.

Beyond 2023, the Commission has indicated that high quality public investment should be promoted and protected in Member States’ medium-term fiscal plans (2).

At the same time, Member States should ensure fiscal sustainability and debt reduction through a multi-year, gradual and high- quality fiscal adjustment and investment and reforms sustaining economic growth.
