DE LA COMMUNE DE LAVARDAC

Séance du 12 juin 2024

L'an deux mille vingt-quatre, le douze |juin, à 20 h 30, le Conseil Municipal de la Commune de Lavardac, régulièrement convoqué, s’est réuni au nombre prescrit par la Loi, dans le lieu habituel de ses séances, sous la Présidence de Monsieur Ludovic BIASOTTO, Maire, à la suite de la convocation du 4 Juin 2024.

Mme Corinne BOUSQUET est désignée pour remplir les fonctions de Secrétaire et prend place au bureau. L'avis de convocation à été affiché conformément à la Loi.

Le compte rendu de la séance du 12 juin 2024 comprenant toutes les délibérations prises par le Conseil Municipal au cours de cette séance, sera affiché conformément aux prescriptions de l'article L 2121-25 du OGCT.

Reprise des concessions en état d'abandon dans le cimetière communal.

Le conseil municipal,

Après avoir entendu lecture du rapport de M. le maire qui lui demande de se prononcer sur h reprise par la commune des concessions figurant sur l'état ci-dessous, toutes situées dans le cimetière communal, avenue des Grands Champs, qui ont plus de trente ans d'existence et dont l'état d'abandon a été constaté à deux reprises, à un an d'intervalle, dans les conditions prévues par l'article L 2223-13 et suivants du Code général des collectivités territoriales, donnant aux communes la faculté de reprendre les concessions perpétuelles et centenaires en état d'abandon ;

Vu le Code général des Collectivités Territoriales, articles L 2223-17 et R 2223-12 à R 2223-21 ; Considérant que les concessions dont il s'agit ont plus de trente ans d'existence et qu'elles sont bien en état d'abandon, ledit état dûment constaté ;

Considérant que cette situation décèle une violation de l'engagement souscrit par l'attributaire des dites concessions, en leurs noms et au nom de leurs successeurs, de la maintenir en bon état d'entretien, et qu'elles sont, en outre, nuisibles au bon ordre et à la décence du cimetière

Décide, à Punanimité :

Article 1, : d'autoriser M. le Maire à reprendre au nom de la commune et à remettre en service pour de nouvelles iohumations les concessions, figurant sur l’état ci-après, en état d'abandon.

Article 2. : de charger M. le maire d'exécuter la présente délibération.
