OBJET Régie des Affaires funéraires

Créances irrécouvrables

Ce rapport a pour objet de solliciter l’approbation du conseil municipal concernant une liste de créances éteintes.

Ces créances concernent quatre sociétés de pompes funèbres qui ont été placées en liquidation judiciaire.

N’ayant pas réglé les paiements dus, la municipalité a émis des titres de recettes pour un montant total de 49 408,18 euros concernant les sociétés suivantes :

- PF OUTRE MER 974,

- PF MARBERIE HOAREAU,

- PF HARMONIE,

- PF REUNION OUTRE-MER.

En conséquence, la direction régionale des finances publiques s’est chargée du recouvrement de cette dette.

Le 6 janvier 2025, la receveuse municipale a informé la collectivité, après plusieurs relances et interventions par voie d’huissier, de la liquidation judiciaire des quatre sociétés.

Le tribunal a également prononcé des jugements de clôture pour insuffisance d’actif, entrainant l’effacement de la dette de ces entreprises.

De fait, les créances sont désormais considérées comme irrécouvrables. Il s’agit d’une décision de justice. Il n’y a pas de recours.

L’avis du conseil municipal est donc demandé pour permettre à la direction régionale des finances publiques de les considérer comme des dettes éteintes.

L’annulation de ces créances sera imputée sur la provision pour créances incertaines.
